Did you read the title of the CLE with enthusiasm or sarcasm? While we often celebrate the holidays as a joyous occasion, the holidays can bring up many complicated emotions—including joy, grief, sadness, isolation, trauma, and more. Navigating stressful seasons—whether it’s the holidays or some other stressful season in life—can impact our ability to maintain our duties of competence (1.1), diligence (1.3), communication (1.4), and supervision (5.1-5.3). This panel session will provide an overview of the potential ethical pitfalls that can occur during these seasons. Attendees will then be provided tools for navigating the stress—for themselves and for their practice.

Kentucky Supreme Court Addresses Legal Malpractice Statute of Limitation

The Kentucky Supreme Court recently held that in a “non-litigation legal malpractice claim” the one-year statute of limitations clock starts “when the claimant is reasonably certain that damages will indeed flow from the defendant’s negligent act.” This opinion overturns prior case law that created uncertainty and did not start the clock on non-litigation legal malpractice claims until the claimant knew the exact dollar amount of damages due to the malpractice. Read the full opinion here.

eFiling Required for Domestic Relations Cases Beginning August 1, 2023

Under Kentucky Supreme Court Administrative Order 2023-21, lawyers must use electronic filing for domestic relations cases beginning August 1, 2023.

Lawyers still needing training on eFiling can register here for live virtual trainings on either July 21st or August 28th. On-demand eFiling trainings are also available through the courts. To Our Policyholders:

We are privileged to have served you, Lawyers Mutual of Kentucky’s (“LMICK”) insureds and the lawyers of the Commonwealth of Kentucky, for another year. In anticipation of the upcoming Annual Meeting (more details below), this is my opportunity each year to tell you about the state of your Company and to reiterate how proud we are to work with you and for you. I decided, however, to take a bit of a different approach. You hear us talk about ourselves - what we do and how we do it - all the time. I thought it might be nice to hear about LMICK from others who know us and can tell you about the Company and how we try to do business in service to you.

LMICK was founded in 1986 by a forward-thinking group of Kentucky lawyers who wanted better for the lawyers of the Commonwealth of Kentucky. In starting LMICK, the goals were 1) to assure availability of professional liability insurance to the lawyers of the Commonwealth of Kentucky; 2) to help the lawyers of Kentucky in meeting their responsibilities to their clients and the public; and 3) to foster competition in the insurance marketplace.

BEWARE: NKBA Warns of Several Hacking Attempts Via Dropbox Links

On April 12th, the Northern Kentucky Bar Association alerted its members to use caution when opening Dropbox links. While the emails seem legitimate, Dropbox accounts have been hacked and bad actors are sharing corrupted links. A few best practice tips:

Celebrating Black History Month

Since 1976, February has been designated Black History Month, aimed at honoring the significant contributions of African-Americans to our country as well as acknowledging the significant struggles faced across generations. The American Bar Association has compiled a great list of resources to help lawyers and firms recognize Black History month. The ABA’s celebration of Black Legal Trailblazers includes Kentucky’s own Lonita K. Baker, President of the National Bar Association.

LMICK is proud to support the NBA’s Midyear Conference, coming to Louisville April 27-30, 2023, which will pay homage to civil rights leaders Gertrude E. Rush and Heman Sweatt. We are excited to welcome the NBA to Kentucky and hope to see you there!
