Lawyers Mutual Offers Kentucky Lawyers Claims-Made and Reported Professional Liability Insurance Covering:
  • A negligent act, error or omission in professional services rendered or that should have been rendered by the insured or by any person for whose acts, errors or omissions the insured is legally responsible, and arising out of the conduct of the insured's profession as a lawyer, title insurance agent or notary public;
  • Personal injury which arises out of the professional services of the insured as a lawyer, title insurance agent or notary public; or
  • Any act, error, omission or personal injury committed by any non-lawyer employee, but arising solely out of legal services rendered within the scope of such person's employment for the named insured, subject to certain exclusions and definitions.

Claims-Made and Reported Policy

Lawyers Mutual offers a claims-made and reported policy, which is now the most common policy form for professional liability insurance. With a claims-made and reported policy, two conditions must be met to trigger coverage. The claim must first be made and reported to Lawyers Mutual during the term that the policy is in effect. Second, the act, error or omission giving rise to the claim must have occurred on or after the policy’s retroactive date. Malpractice committed prior to the retroactive date is not covered. Lawyers Mutual often offers policies with no retroactive date, which means that we offer coverage for any prior acts, errors or omissions that result in a claim first received and reported during a policy period.

A Full Range Of Insurance Limits Is Available

We offer a variety of coverage limits, with per claim limits and annual aggregate limits ranging from $100,000 to $5,000,000. In addition, we offer per claim deductibles, as well as aggregate deductibles.

All Around Coverage

We recognize that lawyers often wear several different hats in the legal profession. Whether you are an elected official, such as a county or commonwealth attorney, a city attorney, a court commissioner, a title insurance agent, a notary public, a mediator or an arbitrator, you will be covered by our policy at no additional charge.

Reduced Rates For New Lawyers

New lawyers receive a sixty percent discount during their first year of practice and graduated discounts through their fourth year of practice.

Special Features

  • Full Prior Acts coverage is often available for errors or omissions occurring prior to the commencement of your policy.
  • There is no automatic premium penalty or surcharge for reporting potential claims.
  • Immediate coverage at no charge for new partners, associates and employees joining your firm during the term of your policy, with no additional premium due until your policy’s renewal date.
  • Free “tail” coverage provided upon death or disability, which extends the time period in which to report claims or incidents that occurred during the policy period.
  • Premium financing plans are available.
  • We are a mutual insurance company. This means that each policyholder has an ownership interest in the company. In addition to electing the Board of Directors, policyholders help to determine the policies and procedures that benefit them. Unlike most other malpractice insurance carriers, Lawyers Mutual is owned entirely by lawyers, working for the benefit of other lawyers.
